Terms of Service

1. Acceptance
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and ZeroPhantom ("we", "us"). By accessing our website, purchasing a license, or using any Service, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use our Services.
2. License Grant
Upon successful payment, ZeroPhantom grants you a limited, non-exclusive, non-transferable, revocable license to use the purchased software tool for your own lawful purposes, subject to these Terms. Each license key is issued for a single individual user or a single legal entity. Resale, sub-licensing, or transfer of license keys requires prior written permission.
3. Acceptable Use — General Prohibitions
You agree that you will not use any ZeroPhantom product or service to:
- Send unsolicited bulk email (spam), phishing messages, or any communication that violates applicable anti-spam laws (including CAN-SPAM, GDPR, CASL, or equivalent)
- Conduct fraud, identity theft, impersonation, or any deceptive practice
- Distribute malware, ransomware, viruses, or any harmful code
- Harvest personal data from third parties without authorization
- Violate any applicable local, national, or international law or regulation
- Infringe the intellectual property or privacy rights of any third party
- Reverse engineer, decompile, disassemble, or extract source code from our tools
- Share, sell, or redistribute license keys to unauthorized parties
4. Acceptable Use — Email & Automation Tools
By using any email automation tool from ZeroPhantom, you expressly acknowledge and agree that:
- You are the authorized owner or administrator of all email accounts you use with our tools
- You are solely and exclusively responsible for all emails sent using our tools, including their content, recipients, and compliance with all applicable laws
- ZeroPhantom has no control over, and accepts no responsibility for, the content of emails sent by users of our tools
- You will comply with CAN-SPAM, GDPR, and all other applicable email marketing laws in your jurisdiction
- You will not use our tools to send unsolicited commercial email to recipients who have not given explicit consent
- You accept full liability for any consequences arising from your use, including account suspensions, legal actions by third parties, or regulatory fines
5. Third-Party Platform Compliance
Our software tools may interact with or automate third-party platforms and services. ZeroPhantom does not represent, warrant, or guarantee that use of our tools is permitted under the terms of service of any third-party platform. You are solely responsible for reviewing and complying with the terms of any third-party platform you use in conjunction with our tools. ZeroPhantom expressly disclaims all liability for any account suspension, termination, legal claim, or other consequence arising from your use of third-party platforms.
6. Developer Safe Harbor
ZeroPhantom operates exclusively as a software tool provider. We are not a participant in, nor do we direct, control, or have knowledge of, any specific email campaigns, messages, or automated actions performed by users of our software. The following principles apply:
- We have no visibility into the content of emails sent by users
- We have no visibility into the recipient lists used by users
- We do not initiate, monitor, or supervise user automation sessions
- Our tools function as general-purpose software; any misuse is the exclusive responsibility of the user
- We are not a sender, marketer, or promoter of any communication made using our tools
7. License Key Usage & Enforcement
License keys are issued for single-user use. Keys may include machine-binding, concurrent session limits, or usage rate limits. The following actions will result in immediate key suspension without refund:
- Sharing a license key with other individuals or organizations
- Attempting to bypass or circumvent license validation
- Using the tool in a manner that violates these Terms
- Abnormal usage patterns indicating shared or automated resale use
8. Payment & Delivery
We accept cryptocurrency payments processed via BTCPay Server. License keys are delivered automatically to your email once the on-chain payment confirms. Delivery times are subject to blockchain confirmation speed, which is outside our control. ZeroPhantom is not responsible for delays caused by blockchain congestion or incorrect payment amounts.
9. Credits System
Credits are a virtual in-platform currency redeemable for API services (Temp Mail API, File Converter API). Credits are non-refundable, non-transferable, and have no monetary value outside the platform. Unused credits do not expire unless your account is terminated for Terms violations.
10. Intellectual Property
All software, code, designs, trademarks, and content on ZeroPhantom are the exclusive intellectual property of ZeroPhantom. You receive only the limited license described in Section 2. No ownership rights are transferred.

13. Modifications to Services
ZeroPhantom reserves the right to modify, suspend, or discontinue any part of the Services at any time. For active lifetime license holders, we will provide reasonable notice and attempt to provide equivalent functionality. No refund is owed for feature modifications that do not materially impair core functionality.
14. Termination
We may suspend or terminate your access to any Service immediately, without notice, if you violate these Terms. Upon termination, your license is revoked, all keys are disabled, and you must cease all use of our software. Sections 5, 6, 11, 12, 15, 16, 17, and 19 survive termination.
15. Indemnification
You agree to defend, indemnify, and hold harmless ZeroPhantom, its affiliates, officers, agents, and employees from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of the Services or any product purchased from ZeroPhantom
- Any email, message, or communication sent using our tools
- Your violation of these Terms or any applicable law or regulation
- Your violation of the terms of service of any third-party platform
- Any claim brought by a recipient of communications sent using our tools
- Any claim brought by a third-party platform (including Google, Apple, or Microsoft) arising from your use of our tools
- Your infringement of any intellectual property or privacy rights
- Any regulatory action or fine imposed on ZeroPhantom arising from your activities
16. Dispute Resolution
In the event of any dispute arising out of or relating to these Terms or the Services, the parties agree to first attempt resolution through good-faith negotiation for a period of at least thirty (30) days following written notice of the dispute. If the dispute is not resolved through negotiation, it shall be finally settled through binding individual arbitration conducted in a mutually agreed neutral venue. You waive any right to participate in a class action lawsuit or class-wide arbitration against ZeroPhantom.
17. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. The parties agree that any arbitration or legal proceedings shall be conducted on an individual basis only and not as a class or representative action.
18. Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, and Acceptable Use Agreement, constitute the entire agreement between you and ZeroPhantom regarding the Services and supersede all prior agreements, representations, and understandings.
19. Severability
If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
20. Changes to Terms
We may update these Terms at any time. We will notify registered users of material changes via email. Your continued use of the Services after the effective date of changes constitutes your acceptance of the updated Terms.
