Acceptable Use Agreement

1. Scope

This Acceptable Use Agreement ("AUA") applies to all users of ZeroPhantom software tools including but not limited to Gmail Automation Tool, Email Warmup, and any other automation or sending tool provided by ZeroPhantom. It supplements and forms part of the full Terms of Service.

2. Absolute Prohibitions

You may not under any circumstances use ZeroPhantom tools to:

• Send unsolicited commercial email (spam) to any individual who has not explicitly opted in to receive communications from you
• Conduct phishing attacks, impersonation, or any form of fraud or social engineering
• Send emails containing malware, ransomware, viruses, or any harmful code
• Harvest, scrape, or collect email addresses without explicit authorization
• Send threats, harassment, hate speech, or any unlawful content
• Violate CAN-SPAM, GDPR, CASL, or any applicable email marketing law in any jurisdiction
• Impersonate any individual, company, government body, or brand
• Use accounts that do not belong to you or that you are not authorized to operate

3. Your Sole Responsibility

You acknowledge and agree that:

• You are the sole author and sender of all emails and communications transmitted using our tools
• You are solely responsible for obtaining all legally required consents from recipients before sending any commercial email
• You are solely responsible for maintaining opt-out/unsubscribe mechanisms as required by law
• ZeroPhantom has no knowledge of, control over, or involvement in your specific campaigns, messages, or recipient lists
• Any legal liability arising from your use of our tools — including fines, lawsuits, and regulatory actions — is borne exclusively by you

4. Third-Party Platform Terms

You expressly acknowledge that:

• You have read and understood the terms of service of any third-party platform you interact with using our tools (including but not limited to Google Gmail, Google Workspace, Apple iCloud Mail)
• You accept full responsibility for any account suspension, restriction, or termination by any third-party platform resulting from your use of our tools
• ZeroPhantom makes no warranty that use of its tools is permitted under any third-party platform's terms of service
• You will not seek any compensation from ZeroPhantom for losses caused by third-party platform actions

5. ZeroPhantom's Role

ZeroPhantom operates exclusively as a passive software tool provider. We:

• Do not write, review, approve, or control the content of your emails
• Do not select or supply your recipient lists
• Do not initiate, monitor, or supervise your sending sessions
• Are not a sender, marketer, or commercial email service provider as defined under CAN-SPAM or GDPR

Accordingly, ZeroPhantom expressly disclaims liability for any violation of email marketing laws or third-party platform terms arising from your use of our software.

6. Monitoring & Enforcement

ZeroPhantom reserves the right to:

• Monitor license usage patterns for compliance with this AUA
• Suspend or terminate any license without notice or refund upon credible evidence of AUA violation
• Cooperate with law enforcement and regulatory authorities in investigating violations
• Pursue legal remedies for violations that cause harm to ZeroPhantom, its infrastructure, or third parties

7. Reporting Violations

If you become aware of a user violating this AUA, please report it through our support page. We take all reports seriously.

8. Indemnification

You agree to indemnify, defend, and hold harmless ZeroPhantom from any and all claims, damages, fines, penalties, and legal fees arising from your violation of this AUA or any applicable law in connection with your use of our tools. This indemnification obligation survives termination of your license and these Terms.

9. Changes

We may update this AUA at any time. Updated versions will be posted at this URL. Your continued use of our tools after an update constitutes acceptance. The version in effect at the time of your purchase governs your original transaction.
